Terms & Conditions

These Terms and Conditions (“Terms”) govern participation in POWERMAN Malaysia events (“Event”) and the use of related services, websites, and registration platforms. By registering for or participating in the Event, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

1. Definitions

  • “Organiser” refers to POWERMAN Malaysia and its appointed event organiser, partners, licensors, contractors, and authorised representatives.

  • “Participant” refers to any individual who registers for, attends, or participates in the Event.

  • “Event” refers to POWERMAN Malaysia races, expos, briefings, and all related activities.

2. Eligibility & Registration

2.1 Participation is subject to meeting the minimum age and category requirements stated on the official Event website.

2.2 Registration is only deemed complete upon:

  • Accurate submission of registration details;

  • Acceptance of these Terms and all related policies;

  • Full payment of applicable fees; and

  • Issuance of an official race bib or identification number.

2.3 The Organiser reserves the right to refuse or cancel any registration at its sole discretion without obligation to provide reasons.

3. Fees, Payments & Refunds

3.1 All registration fees are non-refundable and non-transferable unless expressly stated otherwise in writing by the Organiser.

3.2 No refunds shall be provided for:

  • Failure to attend or complete the Event;

  • Disqualification or Did Not Finish (DNF);

  • Personal injury, illness, or scheduling conflicts;

  • Event disruption caused by weather, force majeure, or safety considerations.

3.3 Any refund, deferment, or transfer policy (if applicable) shall be governed strictly by the Organiser’s published policies.

4. Race Rules & Conduct

4.1 Participants must comply with all official race rules, technical regulations, safety instructions, and directions issued by the Organiser or race officials.

4.2 Bib numbers are strictly personal and non-transferable. Tampering, swapping, or unauthorised use of bibs will result in immediate disqualification.

4.3 The Organiser reserves the right to remove any Participant from the course if deemed unfit to continue or if they pose a safety risk to themselves or others.

5. Cut-Off Times & Results

5.1 Official cut-off times shall be enforced for all race categories.

5.2 Participants failing to meet cut-off times will be withdrawn from the race and classified as Did Not Finish (DNF).

5.3 All timing results are final. The Organiser reserves the right to review, amend, or invalidate results in cases of technical error, rule violations, or misconduct.

6. Health, Safety & Medical Responsibility

6.1 Participants confirm they are medically fit, adequately trained, and capable of participating in a strenuous endurance event.

6.2 Participation is at the Participant’s own risk. The Organiser does not provide medical insurance coverage.

6.3 Participants consent to emergency medical treatment if deemed necessary and agree to bear all associated costs.

7. Assumption of Risk & Liability Waiver

7.1 Participants acknowledge that participation involves inherent risks including, but not limited to, physical injury, illness, permanent disability, or death.

7.2 To the fullest extent permitted by law, Participants waive, release, and discharge the Organiser from all claims, liabilities, losses, damages, or causes of action arising from participation in the Event.

8. Media, Photography & Intellectual Property

8.1 Participants grant the Organiser an irrevocable, worldwide, royalty-free right to capture and use their name, image, likeness, voice, and performance for promotional, commercial, editorial, and archival purposes without compensation.

8.2 All Event-related trademarks, logos, materials, and content remain the intellectual property of the Organiser and its licensors.

9. Personal Data Protection (PDPA)

9.1 The collection and processing of personal data shall be governed by the Personal Data Protection Act 2010 (Malaysia) and the Organiser’s Privacy Policy.

9.2 By registering, Participants consent to the use of their personal data for event administration, safety, results, marketing, and legal compliance purposes.

10. Event Changes, Cancellation & Force Majeure

10.1 The Organiser reserves the right to amend Event details including date, time, course, or format at any time.

10.2 The Event may be postponed, modified, or cancelled due to circumstances beyond reasonable control, including but not limited to weather conditions, public health risks, government directives, or force majeure events.

10.3 In such cases, no refunds shall be due unless expressly stated otherwise by the Organiser.

11. Code of Conduct

11.1 Participants are expected to behave respectfully toward officials, volunteers, other athletes, and the public.

11.2 Abuse, harassment, cheating, or unsportsmanlike conduct may result in immediate disqualification without refund.

12. Governing Law & Jurisdiction

12.1 These Terms shall be governed by and construed in accordance with the laws of Malaysia.

12.2 Any disputes arising shall be subject to the exclusive jurisdiction of the courts of Malaysia.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14. Acceptance

By registering for or participating in POWERMAN Malaysia, the Participant confirms acceptance of these Terms & Conditions in full.
